Kalispell Man Charged with Negligent Homicide

By Beacon Staff

A 54-year-old Kalispell man is charged with negligent homicide in the death of another man during a weekend confrontation.

David Day made an initial appearance in court Monday in the death of 55-year-old Gerald Payne of Kalispell.

Court records say Day told investigators he and Payne had been drinking heavily on Saturday at Montana Village motel in Evergreen. Day told officers they began to argue and he ordered Payne to leave. Court records say when the men were outside, Day hit Payne in the face, causing him to lose his balance and fall down a flight of stairs.

Day’s bail was set at $25,000 on Monday.
