Flathead County Man Denies Vehicular Assault Charges

Garrett Allen Miller allegedly hit a pedestrian while under the influence of marijuana

A Flathead County man denied allegations that he hit a pedestrian while driving under the influence of marijuana.

Garrett Allen Miller pleaded not guilty to felony negligent vehicular assault on June 15 in Flathead County District Court. He is set to stand trial this fall.

According to charging documents, Miller was driving down Whitefish Stage Road on July 23, 2016 when he hit a pedestrian with his vehicle. Miller told law enforcement that he had not seen the pedestrian until moments before impact and was unable to avoid hitting the man.

The man was taken to the hospital and treated for a fractured fibula, kidney laceration, and a fractured knee, among other injuries.

Miller was taken to the hospital for a blood draw that later revealed THC in his blood. During the course of the investigation into the incident, law enforcement found marijuana and other drug paraphernalia inside a bag in the car.
