High Court Overturns Kalispell Man’s Sex Assault Conviction

The Montana Supreme Court has thrown out the felony sex assault conviction of a Kalispell man.

The court ruled last week that 42-year-old Darwin Keith Berosik was entitled to be present when the process of picking jurors was moved to private chambers.

Now prosecutors must decide whether to retry Berosik.

He was convicted in 2007 of two counts of felony sex crimes for molesting two teens in 2005. Berosik was sentenced to 10 years in prison.

He is expected to return to Flathead County in the coming weeks for a status hearing on his case.
