Evergreen Man Denies Charges in Fatal Fight

A 54-year-old Evergreen man has denied causing the death of another man during a drunken fight in which the victim fell down the stairs.

David Day pleaded not guilty to felony negligent homicide during a District Court hearing Thursday in Kalispell.

Day is charged with hitting 55-year-old Gerald Payne in the face during an argument on June 1, causing Payne to fall down a flight of stairs. Payne died of injuries suffered in the fall.

Court records say Day told investigators he and Payne had been drinking heavily that day and began to argue after he ordered Payne to leave.

Day remains jailed with bail set at $25,000.
