JUDGE BLOCKS KEY PROVISIONS OF MONTANA MEDICAL MARIJUANA LAW
A Montana judge permanently has banned enforcement of key provisions of the state’s medical marijuana law.
District Judge James Reynolds of Helena on Friday permanently blocked several provisions, including the ban on the advertising of marijuana and the prohibition against commercial sale for profit of marijuana to people authorized to obtain it for medical reasons.
The provision against for-profit sales essentially meant that medical mari- juana cardholders had to grow their own pot.
Reynolds struck down provisions that restrict a medical marijuana pro- vider from assisting more than three people licensed by the state to obtain le- gal pot or marijuana-infused products, again without them being able to be paid.
The judge also ruled against a part of the law that required the state to provide the Board of Medical Examiners with the names of any physician who within a 12-month period wrote certifications for medical marijuana for 25 or more pa- tients. Such notice would have required the physician to pay for an automatic review of his practices by the Board of Medical Examiners.
The provisions that Reynolds struck down had never taken effect either be- cause the judge earlier had blocked them or because the state had agreed not to enforce them.
At the same time, Reynolds ruled in the state’s favor and refused to enjoin two provisions in the law that had been challenged.
He let stand a provision allowing the state Department of Public Health and Human Services and state and local law enforcement agencies to make unan- nounced inspections of medical mari- juana providers during normal business hours. Reynolds also blocked enforce- ment of another provision forbidding people under probation or under the su- pervision of the Department of Correc- tions from being able to obtain marijua- na cards.
It wasn’t immediately clear whether Montana Attorney General Tim Fox will appeal Reynolds’ decision. A spokes- man said the attorney general’s office re- ceived the decision late Friday and was reviewing it.
Attorney James Goetz of Bozeman, who represented the Montana Canna- bis Industry Association and others, praised the decision.
“It’s a pretty complete victory for us,” Goetz said. “Those are two tangen- tial provisions that he upheld.”

KALISPELL MUSEUM TO HOST ANNUAL JOHN WHITE SERIES
Each winter the Museum at Cen- tral School in Kalispell offers a chance to hear noted speakers presenting on Montana history and culture. The 13th annual John White series begins Sun- day, Jan. 11, at 2:30 p.m. with University of Montana history professor Anya Ja- bour speaking on “Montana Women in History.” Jabour is a history professor and co-director of Women’s and Gender Studies at the University of Montana, where she has received several awards for teaching and scholarship.
On Sunday, Jan. 25, 2:30 p.m., “Flat- head Memories” will feature a panel presentationfeaturingtwolocalcouples with a wealth of history in the Flathead Valley. Cliff & Lynda Collins were among the founding members of the Northwest Montana Historical Society and the Museum at Central School, and Cliff served on the Kalispell City Coun- cil, being one of the five council votes in 1997 that saved Central School and funded the restoration that created the Museum we have today. Bill and Lois McClaren are also well known through- out the valley, for many civic contribu- tions, and also as preeminent dahlia growers and breeders. Bill is the last liv- ing founder of Flathead Valley Commu- nity College.
On Sunday, Feb. 8, the museum will host a living history representation of Montana artist Charlie Russell’s wife, Nancy Cooper Russell, present- ed by Mary Jane Bradbury. Nancy Russell is credited with helping Charlie Russell become the highest paid living artist of his time, and art historians be- lieve without Nancy Russell, the world might never have seen Charlie Russell’s work.
Closing out the 2015 series on Feb. 22 will be wildlife biologist and local au- thor, Doug Chadwick, speaking of his experiences exploring ecosystems from Siberia to the Congo, and Cana- da to Northwest Montana. Chadwick received his bachelor’s degree in zoology from the University of Washington and a master’s degree in wildlife biology from the University of Montana. After work- ing as a seasonal biologist in Glacier Na- tional Park, he turned to popular writ- ing about nature and conservation. The author of 11 books, Chadwick has also produced hundreds of articles for publi- cations as varied as Reader’s Digest and the New York Times Review of Books.
