KALISPELL INMATE ACCUSED OF ATTACKING FEMALE JAIL GUARD
An inmate at the Flathead County Detention Center attacked a female jail- er and tried to drag her into his cell on Aug. 18, according to court documents. Robert James Price pleaded not guilty to felony assault on a peace officer on Aug. 28 in Flathead County District Court.
Price was in the detention center for his sixth driving under the influence of- fense when he was being moved for med- ical reasons. During the medical pass, Price became agitated with the female sergeant who was moving him. In hopes of calming him down, the officer decided to return Price to his cell.
Price walked backwards into the cell and once standing inside he allegedly reached out and grabbed the sergeant and tried to drag her behind the bars. Another officer tried to radio for help, but her radio failed. As Price continued to pull her into the cell and make sexu- ally degrading remarks, the sergeant braced herself against the door of the cell. Finally, as Price let go, the officers tried to shut the cell door but the inmate charged the door. The officers were able to push back and lock the cell door.
Later on Aug. 18, Price saw the same officer again and threatened her, saying “I could have thrown you on the ground and ripped you apart if I wanted to. Don’t make those kind of mistakes like that with men like me,” according to court records.
If convicted Price could face 10 years in prison and pay a fine of $50,000.
A trial has been set for Feb. 2, 2015.
CORONER IDENTIFIES WALMART EMPLOYEE WHO DIED AFTER FATAL FALL
Authorities have identified the 57-year-old Kalispell man who died af- ter an accident at Walmart.
Larry Wurtz was working at the Walmart on Hutton Ranch Road when he fell from a ladder Aug. 17, according to Flathead County Sheriff and Coroner Chuck Curry. Wurtz was transported to Kalispell Regional Medical Center and died four days later as a result of a head injury.
The manner of death has been listed as accidental, Curry said.
The Occupational Safety and Health Administration is investigating the in- cident. Conflicting witness statements have been reported about the accident and the area manager of OSHA said the fall involved a movable staircase in a storeroom and not a ladder.
Jeff Funke says OSHA is sorting out witness statements and the investiga- tion may take four to six months. Fun- ke said the investigation is also looking into the time it took an ambulance crew to respond to the store. OSHA regula- tions require a workplace to “ensure the ready availability of medical personnel” or have employees trained to render first aid.

JUDGE REJECTS SENATE LEADER’S CONSPIRACY CLAIMS
A Helena judge has dismissed claims by the Montana Senate majority leader that the governor, a state senator and two commissioners of political practices conspired to drive him out of office.
Sen. Art Wittich, R-Bozeman, made the claims while defending himself against a civil lawsuit by Commissioner of Political Practices Jonathan Motl al- leging Wittich violated campaign laws by coordinating with and taking illegal corporatecontributionsfromthesecre- tive conservative group Western Tradi- tion Partnership.
Wittich could be removed from of- fice if District Judge Jeffrey Sherlock up- holds Motl’s findings.
Wittich filed counterclaims against Motl in May accusing the commissioner of having an ulterior motive for forcing Wittich out of the Legislature. He also accused Motl, Gov. Steve Bullock, state Sen. Bruce Tutvedt, R-Kalispell, and former political practices commissioner Jim Murry of conspiring to do just that.
Sherlock rejected each of Wittich’s claims in the decision on Tuesday, meaning the case against Wittich will proceed.
ONLY ONE CANDIDATE DEBATE SET BEFORE ELECTION DAY
With more than two months to go before the general election, the only U.S. House and Senate candidate debates scheduled so far will be on Oct. 4 in Boz- eman, officials said.
Montana Television Network News Director John Stepanek said he expects the major party candidates to partici- pate. The debates will be broadcast from 7 to 10 p.m. statewide.
“We have acceptances for both rac- es,” he said, adding participants do not include candidates from the Libertarian Party.
Stepanek said he had confirmed with all the candidates, but a spokesman for Republican U.S. Senate candidate Steve Daines said his camp hadn’t given final confirmation.
