Marion Boy Put on Probation for Shooting

A 10-year-old Marion boy who was charged with shooting a 7-year-old girl in the stomach last summer will remain under Youth Court supervision until he is 18.

Devon N. Brown was designated a youth in need of intervention and placed on probation during a District Court hearing Thursday.

Prosecutors sought the designation after a criminal endangerment charge was dropped because a psychologist determined Brown was not competent to fully understand the charge against him or assist in his defense.

As a condition of his probation, Brown is not to use, possess or have access to any form of weapon.

Investigators believe Brown was firing a .22-caliber rifle outside a Marion home on June 8, 2008, when a bullet hit Kayla Oswald in the stomach. She suffered serious internal injuries, underwent several surgeries and spent nearly a month in the hospital.
