Trial to Start in Toddler Shooting Death

A jury trial is scheduled to start Monday in the case of a man charged with shooting his girlfriend’s daughter to death.

Dwayne Smail is charged with deliberate homicide in the March 2008 shooting death of 19-month-old Korbyn Williams in the Kalispell area.

Smail told investigators Korbyn was holding the gun when it discharged. Smail, 24, was watching the girl while her mother worked.

The Flathead County sheriff’s office said there was no evidence to indicate the child had the weapon in her hand when it discharged.

The jury trial is scheduled to last four days.
