BILLINGS – A 68-year-old man has been charged in Billings with what prosecutors say is his sixth drunken-driving offense.
The Billings Gazette reports that William Bernard Bergin appeared in District Court on Friday by video from the county jail and pleaded not guilty to felony DUI. His bail was set at $25,000.
Court records say a woman saw Bergin pull into a Billings parking lot the afternoon of Oct. 26 and then lie down on the pavement. Police say when they arrived they found the man passed out on the bench seat of his pickup truck with two empty whiskey bottles.
Court records say Bergin did poorly on a field sobriety test and refused to give a breath sample.
Prosecutors say he was convicted of DUI in 1999, 2003, 2005, 2006 and 2008.
