Evergreen Girl Moves to Drop Lawsuit After Crash

An attorney for a 17-year-old Evergreen girl convicted of two counts of deliberate homicide in a fatal crash has moved to drop a lawsuit filed against the victim’s estate and construction companies working on the road where the crash occurred.

Maxwell Battle filed a motion to dismiss the lawsuit Friday, a day after Justine Winter was convicted in the March 2009 crash that killed 35-year-old Erin Thompson and her 13-year-old son Caden Odell.

Winter filed the lawsuit in July 2010 alleging Thompson negligently operated her vehicle, causing it to collide with Winter’s vehicle. The lawsuit also alleged the construction companies failed to adequately light and mark the construction area.

Prosecutors alleged Winter deliberately drove her car into oncoming traffic in a suicide attempt.
