A judge has denied a Kalispell woman’s request for a restraining order against the man who shot her husband to death last month, saying there was no evidence she should reasonably fear the man.
KCFW-TV reports District Judge David Ortley on Wednesday denied Heather Fredenberg’s request to continue a temporary restraining order against Brice Harper after a hearing Wednesday.
Harper shot 40-year-old Daniel Fredenberg in Harper’s garage on Sept. 22. Flathead County prosecutors declined to file charges because of state self-defense laws.
Heather Fredenberg said that Harper had made previous threats against her husband and the shooting now makes her fear for her life and the lives of her children.
Fredenberg told officers investigating the shooting that she “pretty much had an affair” with Harper.
Harper declined comment after the hearing.
