Polson Man Faces Attempted Homicide Charge

POLSON — Prosecutors in Lake County are seeking to file an attempted deliberate homicide charge against a Polson man suspected of hitting a 67-year-old man in the head with a claw hammer, after mistaking him for another man he believed owed him money.

KERR-AM reports deputy county attorney James Lapotka filed a motion in District Court on Thursday that also seeks permission to charge 35-year-old Desmond Alan Mackay with two counts of assault with a weapon for the March 5 attack on John Barrows. Doctors say it is questionable whether Barrows will survive.

Lapotka’s affidavit alleges Mackay tried to strike Jesse Waugh in the head with a hammer in a surprise attack, but instead struck Barrows. Waugh held Mackay until police arrived.

Court records say Mackay told investigators he meant to hit Waugh.
