HELENA – Sen. Jon Tester is among those in Congress urging the U.S. Supreme Court to overturn state bans on same-sex marriage.
The Montana Democrat joined 43 other senators and 167 representatives in signing a court brief on Friday.
Thirty-seven states, including Montana, recognize same-sex marriage, while 13 do not.
Last November, U.S. District Judge Brian Morris struck down Montana’s constitutional amendment that limited marriage to being between a man and a woman.
Montana Attorney General Tim Fox is appealing that decision.
Two years ago, Tester joined in filing a similar brief urging the U.S. Supreme Court to overturn the federal same-sex marriage ban.
