Charlo Man Given Chance to Withdraw Guilty Plea

Lozeau pleaded guilty in January to killing his brother in June during an argument over pickup repairs

POLSON — A sentencing hearing has been postponed for a 53-year-old Charlo man who had pleaded guilty to killing his younger brother.

Harry Lozeau is being given one week to decide if he wants to withdraw a guilty plea to deliberate homicide.

Lozeau pleaded guilty in January to killing his brother in June during an argument over pickup repairs.

KERR-AM in Polson reports that District Judge James Manley said he would not abide by the recommended 40-year prison sentence in the plea agreement. Lozeau would have been eligible for parole after about 10 years.

Manley says he wants Lozeau of serve 20 years in prison before being eligible for parole. So the judge has given Lozeau the opportunity to withdraw his plea and seek a trial.
