Armed Protesters Declare Victory in Montana Mining Dispute

Federal prosecutors filed a lawsuit to determine the miners' rights to the land above their claim

HELENA — Armed protesters who say they are protecting a Montana mine from government interference are declaring victory after federal prosecutors filed a lawsuit to determine the miners’ rights to the land above their claim.

The U.S. Attorney’s Office filed the lawsuit Tuesday seeking a judge’s ruling that miners George Kornec and Phil Nappo acted illegally in building a garage, cutting down trees and opening a road.

A spokesman for the Oath Keepers, 3% of Idaho and the Pacific Patriot Network says the groups’ objective was to ensure the miners have their day in court.

Chris McIntire said Wednesday that objective has been achieved, but the groups’ members will remain at the mine near Lincoln until a court date is set.

Prosecutors say the miners and protesters are illegally blocking access to Helena National Forest land.
