A 35-year-old man has been sentenced to 40 years at the Montana State Prison with 15 suspended after he raped and impregnated a 15-year-old girl in 2014.

Jaymason William Bottin was sentenced in Flathead County District Court on charges of sexual intercourse without consent on Nov. 12.

According to court documents, the Flathead County Sheriff’s Office received a report from child protective services in October 2014 of a 15-year-old girl who was pregnant. A detective interviewed the girl who said that she had sex with Bottin three months earlier. The girl decided to get an abortion and DNA evidence from the procedure was matched to Bottin. Authorities interviewed Bottin who admitted that he had sex with the girl on two different occasions. Bottin was charged with sexual intercourse without consent in November 2014.

In a deal signed earlier this year, Bottin agreed to plead guilty to the charges. Public Defender Greg Rapkoch argued for a net sentence of 25 years to the Montana State Prison with 15 suspended. Prosecutors argued for 40 years with 15 suspended and District Court Judge Robert Allison agreed.

Bottin also received two concurrent sentences of seven and 10 years for violating his probation in two previous felony convictions; in 2005 he was convicted of writing bad checks and criminal possession of drugs with intent to distribute.

Bottin also has to register as a level II sex offender.
