POLSON — A 54-year-old Charlo man has been found guilty of negligent homicide for shooting his brother in the head with a rifle during an argument over uncompleted pickup repairs.
KERR-AM reports Harry Lozeau was convicted after a two-day trial in Helena this week and sentenced to 20 years in prison. He must serve at least 10 years before he is eligible for parole.
Lozeau had pleaded guilty to deliberate homicide in January in an agreement that called for a 40-year prison term with no parole restrictions. Under state law, he would have been eligible for parole after 10 years.
District Judge James Manly rejected the agreement, arguing Lozeau should have to spend at least 20 years in prison for the June 2014 death of 51-year-old Terry Lozeau.
