HELENA — A Lewis and Clark County sheriff’s deputy is facing an assault with a weapon charge after being accused of hitting and pulling a gun on a man while drunk at a party.

The Independent Record reports 49-year-old Phillip Jay Clark was booked into the county jail Monday and released on his own recognizance.

Court documents say Clark brandished the gun at the alleged victim during a bonfire outside his home on Dec. 4.

The victim, identified in court documents as C.F., says Clark was drunk during the party when he hit him several times and eventually pulled a gun on him.

Clark’s attorney says the agent who investigated the case failed to talk to his client and other witnesses. He says an interview with Clark “would include self-defense claims.”
