Patient Sues State Mental Hospital Claiming Rape

Woman says she was raped by another patient, resulting in a child

HELENA — A woman who was criminally committed to Montana State Hospital is claiming she was raped by another patient at the facility.

Lee Newspapers of Montana reports that in a lawsuit filed last week in District Court in Helena, the woman says the state psychiatric hospital failed to supervise her adequately, leading to the rape that ultimately resulted in the birth of a child.

According to the lawsuit, the woman suffered from episodes of sexual delusions and intrusive sexual thoughts.

The woman is claiming negligence, denial of the right to a safe environment, a failure to supervise and infliction of emotional distress and is asking for damages of $1.5 million to help care for a child that resulted from the rape.

A Department of Health and Human Services spokesman declined to comment on the ongoing litigation.
