Judge Reinstates Medical Marijuana License Revoked by State

Montana Department of Public Health and Human Services revoked Montana Organic Medical Supply owner Steven Palmer's license in August

By Associated Press

BILLINGS — A Montana district judge has ruled that the state improperly revoked a Billings medical marijuana provider’s license by not giving the dispensary owner time to correct violations before revoking the license and effectively shutting down the business.

The Billings Gazette reports Yellowstone County District Judge Don Harris reinstated Montana Organic Medical Supply owner Steven Palmer’s license on Monday.

Palmer had been a licensed provider in Billings since 2011 until the Montana Department of Public Health and Human Services revoked his license in August due to multiple violations found during a June inspection.

Palmer sued the department, alleging that the department’s notice of the violations stated he had until September to address the issues.

The department’s lawyer, Andrew Huff, argued that the violations posed an immediate risk to the public’s health safety. Harris rejected that argument.
