AG Fox Appeals Missoula Gun Lawsuit to State Supreme Court

Missoula officials enacted an ordinance in 2016 requiring background checks on all gun sales

MISSOULA – Montana Attorney General Tim Fox is taking his challenge of the city of Missoula’s gun regulations to the state Supreme Court.

The Missoulian reports Fox is appealing three rulings by Missoula County District Judge Robert Deschamps, who had overturned Fox’s decision to void a city ordinance.

Missoula officials enacted an ordinance in 2016 requiring background checks on all gun sales.

Fox voided the measure, arguing that local governments don’t have authority to restrict gun sales.

Deschamps in October ruled in favor of the city lawsuit that claimed it did have authority.

The judge later denied Fox’s motion to reopen the case.
