Montana, New Jersey Ask Judge to Rule on Dark-money Lawsuit

HELENA — Attorneys for Montana and New Jersey are asking a federal judge to rule on their dark-money lawsuit against the Internal Revenue Service and the Treasury Department without a trial.

Montana Gov. Steve Bullock and New Jersey Attorney General Gurbir Grewal filed a motion for summary judgment this past week as they seek to block a rule change ending the requirement of some tax-exempt groups to disclose the identities of their major donors.

Bullock said in a statement Friday that the IRS decision to change the Nixon-era rules designed to prevent fraud and abuse by groups with nonprofit status was made with no notice or public comment.

U.S. government attorneys are asking the judge to throw out the case, saying states shouldn’t be allowed to dictate what information the IRS collects.
