HELENA — A 23-year-old Montana City man is serving five years in prison and then probation after he pleaded guilty in February to felony charges related to a drunken driving accident that left one man dead.

The Independent Record reports Cal Erickson Mullen’s blood alcohol level was at .265 when he crashed his truck and left it on Interstate 15, where a 2010 Nissan Murano with four passengers collided with it.

The parents of 38-year-old Wyman Hewitt, who died in the accident, spoke at the Wednesday sentencing hearing. Jefferson County Attorney Mathew Johnson said they didn’t want Mullen spending his life in jail.

Johnson said the recent engineering graduate from the University of Montana was ordered to pay more than $358,000 in restitution. He faces 15 more years in jail if he violates probation, which will be contingent upon completion of alcohol treatment programs.
