A Lakeside man accused of shooting out a window during an argument has pleaded not guilty to charges of assault with a weapon and criminal possession of drugs.

David Leith appeared in Flathead County District Court on Aug. 13.

According to court documents, police responded to a Lakeside residence on Aug. 3 after a woman reported that her boyfriend was being aggressive. The woman told police that she and Leith had gotten into an argument and that he had left the home.

A short while later, Leith allegedly returned to the residence, took the woman’s gun and fired at a window. Prosecutors say Leith then took two bottles of prescription drugs that belonged to the woman and left the house.

Police located Leith and searched the vehicle where they found the handgun and the woman’s prescription drugs.

If convicted, Leith could face up to 25 years in prison and up to $100,000 in fines. Leith is expected to go to trial this fall.
